In short, almost all companies that share any data about consumers whom they don't have a direct relationship with must register.

By â€‹California's definitions, any business inside or outside of California that participates in "selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for monetary or other valuable consideration” must register.

What is the California Delete Act?

Starting January 2024, the state of California is requiring many companies that work with data about consumers they don't have a direct relationship to register as a Data Broker with the California Privacy Protection Agency (CPPA) and pay the filing fee annually.

The deadline to file was January 31st, 2024, and the penalty for non-compliance is over $200 a day plus additional penalties. It's important for business owners to file as fines are cumulative as fines can easily exceed $100,000 year.

What do covered companies need to do?

  • January 2024 - covered companies must register as a Data Broker with the California Privacy Protection Agency (CPPA) and pay the filing fee annually

  • ​July 2024 - covered companies must publicly display the number of Data Subject Access Requests they received in the last year, as well as the median and the mean number of days it took the company to respond to those requests

​

  • August 2026 - covered companies must access the CPPA's accessible deletion mechanism at least once every 45 days and process all deletion requests

​

  • January 2028 - and every 3 years thereafter, covered companies must undergo an audit by an independent third party to determine compliance
